All photographs, videos, and other digital content made available on GorillaUpload.com (“Content”) are the exclusive intellectual property of GorillaUpload.com and/or its owner, unless explicitly stated otherwise. All Content is protected by United States and international copyright laws.

No ownership rights are transferred to you through download, purchase, or use of the Content.

Commercial use of any Content—regardless of license type—is prohibited without prior written authorization from GorillaUpload.com.

Commercial use includes, but is not limited to:

• Advertising or promotional materials
• Brand, product, or service marketing
• Monetized social media posts or channels
• Broadcast, streaming, or paid distribution
• Use by businesses, organizations, or sponsors
• NFTs or blockchain-based uses

All commercial licensing requests must be submitted in writing and are negotiated case-by-case. GorillaUpload.com reserves the right to approve, deny, price, or restrict any commercial license at its sole discretion.

5. Prohibited Uses

You may not:

• Resell, sublicense, share, or redistribute Content
• Alter or remove copyright notices or metadata
• Use Content in a defamatory, unlawful, or misleading manner
• Use Content in connection with pornography, hate speech, or illegal activities
• Claim ownership or authorship of the Content

All Content is provided “AS IS” and “AS AVAILABLE.” GorillaUpload.com makes no warranties, express or implied, including but not limited to:

• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness
• Availability or uninterrupted access

You are solely responsible for how you use the Content. It is your responsibility to determine whether additional permissions (including but not limited to model releases, venue permissions, or trademark clearances) are required for your intended use.

8. Indemnification

You agree to indemnify, defend, and hold harmless GorillaUpload.com, its owner, affiliates, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including attorneys’ fees) arising from:

• Your use or misuse of the Content
• Your violation of these Terms
• Any unauthorized commercial use
• Any claim brought by a third party related to your use of the Content

9. Limitation of Liability

To the maximum extent permitted by law, GorillaUpload.com shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, even if advised of the possibility of such damages.

In no event shall GorillaUpload.com’s total liability exceed the amount you paid for the specific Content giving rise to the claim, or zero dollars ($0) for Non-Revenue Content.

10. Termination

GorillaUpload.com reserves the right to terminate or revoke access to the Site or Content at any time, without notice, for violations of these Terms.

Upon termination, all licenses granted to you immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

12. Changes to Terms

GorillaUpload.com reserves the right to modify these Terms at any time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
